Commercial text marketing is evolving and so are the requirements and regulations for safe and secure text messaging. Federal agencies such as the Federal Trade Commission and the Federal Communications Commission, along with various state agencies and the CTIA, have enacted laws, rules, and regulations that place restrictions on certain types of phone calls and text messages. An example of those restrictions include, but are not limited to:

Sending unsolicited marketing messages or broadcasts (i.e., phishing scams, spam)

Transmitting, associating, or publishing any unlawful, racist, harassing, defamatory, abusive, threatening, demeaning, immoral, harmful, vulgar, obscene, pornographic, or otherwise objectionable material of any kind

Offering loan origination or matching services such as payday loans or short-term loans

Promoting or endorsing the use or consumption of alcohol or tobacco, as well as any other product/service that is considered federally illegal such as marijuana or gambling

The CTIA Short Code Monitoring Program is also a great reference for acceptable text messaging practices.
